{"id":9218,"date":"2024-08-01T12:17:07","date_gmt":"2024-08-01T09:17:07","guid":{"rendered":"https:\/\/www.hlhr.gr\/?p=9218"},"modified":"2024-08-05T14:16:10","modified_gmt":"2024-08-05T11:16:10","slug":"greece-ec-rule-law-report-2024","status":"publish","type":"post","link":"https:\/\/www.hlhr.gr\/en\/greece-ec-rule-law-report-2024\/","title":{"rendered":"Greece: EU Ignores Deteriorating Rule of Law"},"content":{"rendered":"<p style=\"text-align: center;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\"><strong><span style=\"color: #000000;\">Greece: EU Ignores Deteriorating Rule of Law<\/span><span style=\"color: #000000;\"><span lang=\"en-GB\"><i><br \/>\n<\/i><\/span><\/span><span style=\"color: #000000;\"><span lang=\"en-GB\"><i>Misleading Report Plays Down Curbs in Media, Civic Space<\/i><\/span><\/span><\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\"><span style=\"color: #000000;\">(Brussels, August 1, 2024) \u2013 The European Commission&#8217;s <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/commission.europa.eu\/document\/download\/6741f4b2-6a10-44ba-b40c-97a5a38e6827_en?filename=21_1_58062_coun_chap_greece_en.pdf\">2024 Rule of Law Report<\/a><\/u><\/span><span style=\"color: #000000;\">,<\/span> <span style=\"color: #000000;\">published on July 24,<\/span><span style=\"color: #000000;\"> 2024, misleads readers about <\/span><span style=\"color: #000000;\">the state of the rule of law in <\/span>Greece<span style=\"color: #000000;\"><span lang=\"en-GB\"> at a time when <\/span><\/span><span style=\"color: #000000;\">media freedom and civic space<\/span><span style=\"color: #000000;\"><span lang=\"en-GB\"> face dire threats and attacks<\/span><\/span><span style=\"color: #000000;\">, 14 human rights and media freedom organizations said today.<\/p>\n<p>Th<\/span><span style=\"color: #000000;\"><span lang=\"en-GB\">e overly positive account in the report <\/span><\/span><span style=\"color: #000000;\">starkly contrasts an alarming reality experienced by journalists,<\/span> <span style=\"color: #000000;\">activists,<\/span> <span style=\"color: #000000;\">and civil society organizations on the ground,<\/span> <span style=\"color: #000000;\">and a growing international concern over the deterioration of the rule of law in the country, which was highlighted by 17 human rights and press freedom groups in a <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.hrw.org\/news\/2024\/02\/06\/joint-ngo-letter-european-commission-president-ursula-von-der-leyen-regarding-media\">February 2024 letter<\/a><\/u><\/span><span style=\"color: #000000;\"> to European Commission President Ursula von der Leyen.<\/span><\/span><\/p>\n<p><!--more--><\/p>\n<p><span style=\"font-family: georgia, palatino, serif; font-size: 12pt;\"><span style=\"color: #000000;\">The European Commission\u2019s report, ignores a stark discrepancy between the Greek government&#8217;s self-reported data and <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.freepressunlimited.org\/en\/current\/highlighting-threats-media-freedom-eu-commissions-rule-law-report\">alarming<\/a><\/u><\/span> <span style=\"color: #467886;\"><u><a href=\"https:\/\/vouliwatch.gr\/resources\/file\/2024\/1\/23\/7faddab0-f44b-47fa-9953-eb8acccaa346.pdf\">accounts<\/a><\/u><\/span><span style=\"color: #000000;\"> submitted to the European Commission by civil society organizations and journalists. It disproportionately focuses on positive developments, without weighing them against the broader systemic issues and ongoing violations. This raises concerns about the Commission&#8217;s willingness to confront the depth of the crisis in a European Union member state, and uphold the rule of law and fundamental rights in Greece.<\/p>\n<p>By glossing over critical issues in Greece facing the media and civil society, the European Commission\u2019s findings risk emboldening the Greek government&#8217;s crackdown on independent media and civil society, the groups said.<\/p>\n<p>Greece consistently ranks last among European Union countries in the Reporters Without Borders <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/rsf.org\/en\/index\">World Press Freedom Index<\/a><\/u><\/span><span style=\"color: #000000;\">.<\/span> <span style=\"color: #000000;\">In February 2024,<\/span> <span style=\"color: #000000;\">the European Parliament adopted a <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/TA-9-2024-0069_EN.html\">resolution<\/a><\/u><\/span> <span style=\"color: #467886;\"><u><a href=\"https:\/\/www.europarl.europa.eu\/news\/en\/press-room\/20240202IPR17312\/parliament-concerned-about-very-serious-threats-to-eu-values-in-greece\">expressing<\/a>,<\/u><\/span><span style=\"color: #000000;\"> \u201cgrave concerns about very serious threats to democracy,<\/span> <span style=\"color: #000000;\">the rule of law and fundamental rights\u201d in Greece.<\/p>\n<p>While the Commission\u2019s Rule of Law report acknowledges issues with the independence and resources of the media regulator, the independence of public service media, access to information, the persistence of threats to journalists\u2019 safety, and the potential chilling effect of <\/span><span style=\"color: #000000;\">strategic lawsuits against public participation <\/span><span style=\"color: #000000;\">(SLAPPs) and harassment, including by politicians, it fails to grasp the <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.mfrr.eu\/wp-content\/uploads\/2024\/01\/Mission-Report-Greece-2024-1.pdf\">severity of the ongoing crisis<\/a><\/u><\/span><span style=\"color: #000000;\">, the groups said.<\/p>\n<p>The report highlights some positive developments and legislative changes<\/span><span style=\"color: #000000;\"><span lang=\"en-GB\"> such as decriminalizing the offense of simple defamation,<\/span><\/span><span style=\"color: #000000;\"> however inadequately reflects chronic flaws with implementation of past reforms and deep-rooted systemic issues that continue to erode media freedom.<\/p>\n<p>Journalists are intimidated and harassed by <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.hrw.org\/news\/2022\/12\/08\/greece-problematic-surveillance-bill\">invasive state surveillance<\/a><\/u><\/span><span style=\"color: #467886;\"><span style=\"color: #000000;\">, including through the <\/span><\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/insidestory.gr\/article\/who-was-tracking-mobile-phone-journalist-thanasis-koukakis?token=ShEt2at9Yr\">use of commercial spyware<\/a><\/u><\/span><span style=\"color: #467886;\"><span style=\"color: #000000;\">,<\/span><\/span> <span style=\"color: #467886;\"><span style=\"color: #000000;\"><a href=\"https:\/\/www.mfrr.eu\/greece-ahead-of-court-hearing-slapp-lawsuit-against-media-and-journalists-must-be-dropped\/\">abusive legal actions<\/a>,<\/span><\/span><span style=\"color: #000000;\"> and coordinated <\/span><span style=\"color: #000000;\">online smear campaigns, often instigated or amplified by pro-government actors. These tactics not only erode journalists&#8217; ability to work freely but also endanger their lives, safety, and the confidentiality of their sources.<\/p>\n<p>This is compounded by this week\u2019s supreme court\u2019s prosecutor <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.documentonews.gr\/article\/areios-pagos-ekleisan-tin-ereyna-gia-ypoklopes-xoris-na-exetasoyn-os-martyres-toys-dipla-parakoloythoymenoys-apo-eyp-predator\/\">decision<\/a><\/u><\/span> <span style=\"color: #467886;\"><u><a href=\"https:\/\/apnews.com\/article\/greece-sanctions-spyware-intellexa-wiretaps-57ba1b0f8538d867ac1ffd7f13dce1e0\">clearing<\/a><\/u><\/span><span style=\"color: #000000;\"> all Greek state agencies or any state official of responsibility for the use of Predator spyware against dozens of prominent individuals, including journalists, despite <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/govwatch.gr\/en\/finds\/parakoloythiseis-politikon-dimosiografon-kai-epicheirimation-apo-predator-kai-eyp\/\" target=\"https:\/\/govwatch.gr\/en\/finds\/parakoloythiseis-politikon-dimosiografon-kai-epicheirimation-apo-predator-kai-eyp\/\" rel=\"noopener\">documented<\/a><\/u><\/span><span style=\"color: #000000;\"> evidence of their involvement.<\/p>\n<p><\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.saferworldforthetruth.com\/investigations\/impunity-in-europe-uninvestigated-murder-of-greek-journalist-sokratis-giolias\"><span lang=\"en-GB\">Impunity<\/span><\/a><\/u><\/span> <span style=\"color: #000000;\"><span lang=\"en-GB\">for those who threaten and harass journalists<\/span><\/span><span style=\"color: #000000;\"> exacerbates the hostile environment for journalists in Greece as concrete action plans or investigative protocols are not <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.freepressunlimited.org\/sites\/default\/files\/documents\/Joint%20submission%20Rule%20of%20Law%20report%20Greece%202024.pdf\">implemented<\/a><\/u><\/span><span style=\"color: #000000;\">. This week\u2019s acquittal of suspects in the 2021 killing of journalist Giorgos Karaivaz, leaving his death unsolved, further perpetuates the climate of impunity for crimes against journalists in Greece. <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/ipi.media\/greece-new-report-examines-media-capture-in-eu-member-state\/\">A lack of media pluralism<\/a><\/u><\/span><span style=\"color: #000000;\">, including inappropriate <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/govwatch.gr\/en\/finds\/public-service-broadcasting-placed-under-the-control-of-the-prime-minister\/\">government control<\/a><\/u><\/span><span style=\"color: #000000;\"> over state media, and collusion between <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/eu.boell.org\/en\/2021\/06\/07\/state-and-corporate-capture-media-threaten-quality-democracy-greece\">media owners and political interests<\/a><\/u><\/span><span style=\"color: #000000;\"> lead to a pervasive climate of censorship and <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/imeddforumreport.blob.core.windows.net\/main\/documents\/iMEdD_Survey_Journalists_Trust_in_Journalism_EN.pdf\">self-censorship<\/a><\/u><\/span><span style=\"color: #000000;\">, which further distorts the media landscape and undermines journalistic independence.<\/p>\n<p>Civil society organizations and human rights defenders,<\/span> <span style=\"color: #000000;\">particularly those working on migration issues,<\/span> <span style=\"color: #000000;\"><span lang=\"en-GB\">also <\/span><\/span><span style=\"color: #000000;\">face <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/rsaegean.org\/en\/registry-of-ngos-working-with-refugees-and-migrants-in-greece-under-scrutiny\/\">significant obstacles<\/a>,<\/u><\/span><span style=\"color: #000000;\"> and even <\/span><span style=\"color: #467886;\"><u><a href=\"https:\/\/www.hrw.org\/news\/2021\/07\/22\/greek-authorities-target-ngos-reporting-abuses-against-migrants\">criminal charges<\/a>,<\/u><\/span><span style=\"color: #000000;\"> for their work in Greece.
